Sporadic contact resolved

Despite some patchy contact with his son, Mark, after John and his ex-girlfriend, Sarah, split up, the situation worsened when John got a new girlfriend – Sarah refused to let John communicate with his son at all. That’s when John turned to Family Law Assistance for help.

Family Law Assistance advised John to organise mediation in an attempt to resolve matters amicably, but Sarah failed to show up, leaving John no option but to make an application to court. It was tough of John as Sarah made allegations of abuse against him and refused to let their son spend time with John when the new girlfriend was in the house.

Listening to the case, the court did make an order for John to have contact with his son in a contact centre for a short period whilst CAFCASS compiled a Welfare Report. When the conclusion of the report showed there were no welfare concerns, it was declared that there should be scheduled contact time between John and his son, which included some overnight stays.

With Sarah objecting and make creating unreasonable excuses why she wouldn’t comply, Family Law Assistance helped John with the necessary paperwork for a hearing and the questions to ask the CAFCASS officer and Sarah. The outcome was that the court agreed with the recommendations made by CAFCASS and John was permitted to have contact with his son on a regular basis.

Sometimes the journey to get the right outcome is painful, but there is a solution with the right advice.
